By using this website or placing an order with Boris Groh Art, you agree to these Terms of Service together with the Return & Refund Policy, Shipping Policy, and Privacy Policy available on this website. If mandatory law gives you rights that cannot be excluded or limited by contract, those rights continue to apply.
1. Orders and Acceptance
Placing an order is an offer to purchase. Unless an order is expressly subject to an individual shipping quotation, an order is accepted when payment is confirmed. We may contact you before shipment if verification, clarification, export documentation, or shipping arrangements are required.
Orders that display a nominal shipping amount of 0.01 United States dollars for an individual shipping quotation are not accepted as having a final shipping price of 0.01 United States dollars. The final shipping cost must be calculated, communicated, accepted, and paid before dispatch. If the final shipping arrangement is not accepted, the affected order may be cancelled and the applicable amount refunded.
We may refuse or cancel an order before shipment where reasonably necessary because of a material pricing or shipping error, product unavailability, suspected fraud, legal or sanctions restrictions, carrier limitations, declared-value limits, export restrictions, or a destination that cannot be served as displayed. If we cancel an order for such a reason, amounts paid for the cancelled order will be refunded, subject to applicable law.
2. Products, Availability and Production
Products may be printed, produced, stretched, signed, numbered, prepared, packed, or otherwise completed after an order is placed, depending on current availability and our production workflow. We do not guarantee that a particular product is held in ready-to-ship inventory unless expressly stated otherwise.
The fact that a standard product is produced or prepared after an order is placed does not by itself mean that the product is personalised or made to the customer's individual specifications.
Custom or personalised work may include, for example, a non-standard size requested by the customer, a personalised inscription or dedication, or another modification specifically agreed for that customer. A standard artist signature, edition number, or Certificate of Authenticity that forms part of the normal product specification is not, by itself, treated as customer personalisation.
3. Product Presentation and Natural Variations
We make reasonable efforts to present artworks and products accurately. However:
• Colours may appear different depending on screen settings, lighting, photography, or device
calibration.
• Printed and hand-finished products may have minor variations in trim, alignment, texture, or
final dimensions.
• Canvas prints are hand-stretched and their final dimensions may vary slightly from the stated
approximate size.
• Product images may include mockups, styled photographs, or digital previews for illustrative
purposes.
Minor variations that are inherent to the artistic, printing, stretching, or finishing process are
not defects. This does not affect any mandatory rights relating to goods that are faulty, damaged,
misdescribed, or otherwise non- conforming.
4. Prices, Billing and Future Changes
All prices are in United States dollars unless stated otherwise. International payments are invoiced and processed in United States dollars via Payoneer. Customers in Ukraine may pay in Ukrainian hryvnia to the official business accounts of Boris Groh as a registered individual entrepreneur, based on the United States dollar price converted at the exchange rate applicable on the date of payment.
Product prices, shipping rates, shipping methods, carriers, delivery destinations, promotions, product availability, website content, and store policies may be changed, added, restricted, or withdrawn at any time without prior notice. Changes apply to future orders and do not retroactively alter the agreed price or material terms of an order already accepted by us, except where required by law or expressly agreed with the customer.
5. Pricing, Shipping and Configuration Errors
We make reasonable efforts to keep product prices, shipping rates, destination settings, and other website information accurate. Technical, configuration, currency-conversion, typographical, carrier, or other errors may nevertheless occur.
We reserve the right to correct an error at any time. If a material error is identified after an order is placed but before shipment, we may contact the customer with the corrected information or cancel the affected order and refund the applicable amount. We will not charge an additional amount without the customer's authorisation.
6. Shipping, Carriers and Delivery Availability
Shipping availability depends on the product, destination, carrier availability, declared value, package characteristics, customs requirements, legal restrictions, and current operational conditions. We may choose or change the carrier or shipping route before dispatch where reasonably necessary, provided that this does not remove mandatory consumer rights.
We do not ship to Russia, Belarus, Cuba, Iran, North Korea, Syria, Venezuela, Nigeria, Afghanistan, or Palestine. We may also decline other destinations that are unavailable because of legal restrictions, security conditions, fraud risk, unreliable postal services, carrier restrictions, or operational limitations.
The appearance of a country, region, or shipping rate at checkout does not guarantee that shipment is possible. A shipping option may occasionally appear because of a technical, configuration, or carrier-related error. If we determine before shipment that an order cannot be shipped as displayed, we may cancel and refund the affected order or, with the customer's agreement, offer an alternative shipping arrangement.
Tracking information is provided after dispatch where tracking is available. Orders may be split into more than one physical shipment, including where different product categories use different shipping profiles or where splitting is required for value, packaging, customs, or carrier reasons.
7. Customs, Import Taxes and Destination Charges
International orders may be subject to import duties, taxes, customs-clearance charges, brokerage fees, handling fees, storage fees, postal or courier charges, or other charges imposed in the destination country.
Unless and to the extent a particular charge has actually been prepaid by us or collected from us by the carrier, such charges are the responsibility of the recipient. Any import-related amount prepaid by us or collected from us covers only the specific amount actually charged at that time and does not mean that all duties, taxes, or other destination charges have been paid.
The name or price of a shipping method shown at checkout does not indicate that all import charges are included or prepaid. Additional charges may still be assessed by customs authorities, postal operators, couriers, brokers, or other parties. Import rules, tax rates, customs procedures, and carrier charges may change at any time, and we do not control or guarantee them.
8. Customer Responsibilities for Delivery
The customer is responsible for providing a complete and accurate delivery address, responding to reasonable requests from the carrier or customs authorities, completing destination-side clearance where required, paying destination charges for which the recipient is responsible, and collecting or accepting the shipment within the applicable time limits.
Refusing delivery, failing to collect a parcel, or allowing a parcel to be returned to sender does not by itself constitute a valid cancellation or exercise of a statutory right of withdrawal. Where a right of withdrawal applies, the customer must clearly communicate the decision to withdraw in accordance with applicable law and our Return & Refund Policy.
If a shipment is returned because the recipient provided an incorrect or incomplete address, failed to collect it, refused delivery, failed to provide required customs information, or failed to pay charges for which the recipient is responsible, any reshipment, refund, or other resolution will be determined after the parcel is returned and reviewed. Documented additional costs caused by the recipient's failure may be charged or deducted to the extent permitted by applicable law.
9. Original Artworks and Export Formalities
Original artworks shipped internationally may require Ukrainian cultural-export documentation, expert examination, permits, certificates, or other formalities before dispatch. Processing times are determined by the relevant authorities and are not guaranteed. Any production, preparation, export, dispatch, or transit time communicated by us is an estimate unless we expressly confirm a specific date in writing as guaranteed.
10. Returns, Withdrawal Rights, Damage and Loss
Returns, cancellations, statutory withdrawal rights, damage claims, lost shipments, refunds, replacements, price reductions, and claim procedures are governed by our Return & Refund Policy. Except where that Policy or mandatory law provides otherwise, purchases are final after payment is confirmed.
11. Intellectual Property and Ownership of Physical Artworks
Purchase of a physical artwork or print transfers ownership of that physical item to the purchaser after the applicable sale and delivery requirements are satisfied. It does not transfer copyright, reproduction rights, licensing rights, merchandising rights, digital-use rights, or any other intellectual-property rights in the artwork unless expressly agreed in writing.
Images of artworks, product photographs, website text, graphics, and other site materials remain protected by applicable intellectual-property law. No purchase authorises commercial reproduction, publication, licensing, tokenisation, resale of reproductions, or other exploitation of the underlying image or artwork.
12. Fraud Screening, Evidence and Chargebacks
We may hold, verify, cancel, or ship with reasonable safeguards orders that are flagged by fraud checks or contain material inconsistencies. We may request identity, payment, address, or transaction verification where reasonably necessary to protect the customer, the artist, and the store.
Unfounded chargebacks, fabricated claims, manipulated evidence, or other abusive conduct may be disputed using order records, correspondence, tracking, delivery confirmation, photographs, video, carrier documentation, and other available evidence. We may restrict future purchases where reasonably necessary to prevent abuse.
13. Website Use and Changes
You may use the website only for lawful purposes. We may suspend access, correct content, remove products, change website functionality, or discontinue part of the service at any time. We do not guarantee that the website will always be uninterrupted, error-free, or compatible with every device or browser.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Boris Groh Art is not liable for indirect, incidental, special, or consequential losses that are not a reasonably foreseeable direct result of our breach. We are not responsible for customs decisions, changes in import law, third-party service interruptions, or delays caused solely by authorities or carriers where the law does not place that risk on us.
Nothing in these Terms excludes or limits any liability, refund obligation, legal guarantee, delivery risk, or consumer right that cannot lawfully be excluded or limited. In particular, any compensation payable to a customer under mandatory law is not limited merely because a carrier or insurer pays us a lower amount.
15. Governing Law
These Terms are governed by the laws of Ukraine, without prejudice to mandatory consumer rights and other mandatory protections that may apply in the customer's country of residence or otherwise under applicable law.
